This Limitation of Liability document sets out the extent to which MD Technology ("Developer", "we", "our", "us") is liable — or not liable — for damages arising from your use of our apps, website, and services.

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS THE LIABILITY OF MD TECHNOLOGY AND AFFECTS YOUR LEGAL RIGHTS.

By installing, accessing, or using any MD Technology app or service, you acknowledge and agree to this Limitation of Liability. If you do not agree, you must not use our Services.

All MD Technology apps, websites, and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Accuracy, reliability, or completeness of content
  • Uninterrupted, timely, or error-free operation

3. Maximum Extent Permitted by Law

To the maximum extent permitted by applicable law, MD Technology, its owner, employees, affiliates, contractors, and partners shall not be liable for any of the following:

Any direct loss, damage, or expense you may incur as a result of using or being unable to use our Services, even if we have been advised of the possibility of such damages.

Indirect Damages

Any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, information, or goodwill
  • Loss of use or inability to use the Services
  • Cost of substitute goods or services
  • Business interruption or downtime

Errors and Omissions

Any errors, inaccuracies, or omissions in the content, calculations, or information provided through our Services.

4. Specific Limitations — Calculator App

Our calculator apps perform mathematical, financial, health, and other calculations. You acknowledge and agree that:

  • Calculation results are not guaranteed to be error-free.
  • Financial calculations (loan, savings, tax, discount, tip) are estimates only and should not be relied upon for financial decisions.
  • Health calculations (BMI, BMR, ovulation) are for informational purposes only and do not constitute medical advice.
  • Currency conversions use third-party exchange rate data and may not reflect real-time rates.
  • Date and time calculations may vary based on time zones and calendar systems.
  • MD Technology is not responsible for any decisions, actions, or losses based on calculation results.

5. Third-Party Services

Our apps integrate with third-party services including Google AdMob, Firebase Analytics, Firebase Crashlytics, and Google Play Services. We are not liable for:

  • Any actions, errors, or omissions of third-party services.
  • Any data collection, storage, or use by third parties.
  • Any interruptions or failures caused by third-party services.
  • Any content displayed through third-party advertisements.
  • Any changes to third-party APIs or policies that affect app functionality.

Your use of third-party services is subject to their own terms and privacy policies.

6. Device and Platform Limitations

We are not liable for any issues arising from:

  • Device incompatibility, hardware failures, or software conflicts.
  • Operating system updates that affect app functionality.
  • Rooted, modified, or custom-ROM devices.
  • Restricted permissions or modified system settings.
  • Network connectivity issues.
  • Malware, viruses, or security breaches on your device.

7. Advertisements

Our free apps display advertisements through Google AdMob. You acknowledge that:

  • We do not control the specific ads displayed to you.
  • We do not endorse or verify the products or services in ads.
  • We are not responsible for transactions between you and advertisers.
  • We are not liable for any damages arising from interactions with advertisers.

8. In-App Purchases

Any in-app purchases are processed through Google Play. You acknowledge that:

  • Refunds are handled by Google Play per their policy.
  • We are not responsible for billing errors by Google Play.
  • We are not liable for any losses arising from purchase issues.
  • Purchases are non-transferable between accounts.

9. Total Liability Cap

To the maximum extent permitted by law, the total aggregate liability of MD Technology to you for any and all claims arising from your use of our Services shall not exceed:

  • The amount you paid us (if any) in the 12 months preceding the claim, OR
  • INR 1,000 (Indian Rupees One Thousand) — whichever is higher.

If you have not paid us anything, our total liability to you shall be limited to INR 1,000.

10. Indemnification

You agree to indemnify, defend, and hold harmless MD Technology, its owner, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

  • Your use of our Services.
  • Your violation of this Limitation of Liability, our Terms, or any applicable law.
  • Your violation of any third-party rights.
  • Content you submit or share through our Services.

11. Exceptions — What We Cannot Exclude

Nothing in this Limitation of Liability is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law, including but not limited to:

  • Liability for death or personal injury caused by our negligence.
  • Liability for fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded by law.

12. Jurisdictional Variations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. If you are a consumer in such a jurisdiction:

  • Some or all of the above limitations may not apply to you.
  • You may have additional rights under local consumer protection laws.
  • Nothing in this document affects your statutory rights.

13. Time Limit for Claims

To the extent permitted by law, any claim arising from your use of our Services must be brought within one (1) year of the date the claim arose, or be permanently barred.

14. Severability

If any provision of this Limitation of Liability is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Governing Law

This Limitation of Liability shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kolhapur, Maharashtra, India.

We may update this Limitation of Liability from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our Services after changes constitutes acceptance.
